Terms and conditions
1 – General clause
Our sales are subject to these general conditions which prevail over any other purchase conditions, except by formal and express agreement on our part.
Placing an order with our company implies the full and unreserved acceptance of the conditions below unless otherwise notified within 48 hours.
The information in our catalogs, brochures, and price lists is provided for information purposes only and may be updated at any time. We reserve the right to make any changes deemed useful.
2 – Products
We reserve the right to modify the items in our catalog and on our website. The photos are noncontractual.
3 – Delivery time
Delivery times featured in the order confirmation are for information purposes only. Consequently, and unless otherwise agreed, failure to comply with these delivery times shall not give rise to damages, withholding payment, or cancellation of the order.
4 – Delivery and reception
Our goods are sold ex-works. The buyer undertakes transport risks and is responsible for checking the condition of goods on reception. The buyer must note any damage to the products, and their number, in the presence of the carrier. Complaints must be noted on the carrier’s bill of lading and confirmed to the carrier by registered letter with acknowledgment of receipt within 48 hours of receipt of goods. Any complaints and/or copies of complaints made against the carrier must be sent to us within THREE DAYS of reception of goods.
5 – Guarantee
Our products are guaranteed for two years against manufacturing defects subject to normal use and care. As a living material, when used outdoors, the surface of wood changes naturally and its appearance may turn gray and crack. This does not damage the product. Products should be protected when not in use or in the event of bad weather to preserve their original appearance as long as possible and should be maintained regularly with suitable products.
Products will only be replaced after findings made by a representative of our company. The colours of our products may vary slightly from the samples and colour charts shown in real life, on our website or in our catalogues, and we cannot accept the replacement of a product for this reason alone. The colours of our products may vary slightly as a result of ageing, so we cannot guarantee a perfect colour match with previous orders.
The following are expressly excluded from this guarantee:
– changes in the appearance of the wood due to natural aging;
– natural wear and tear of materials used;
– damage caused by failure to follow precautions and advice on product use, maintenance, and storage;
– altered, transformed, or modified furniture;
– stains or spots due to moisture retention and heat, or stains not declared when good were unpacked.
6 – Price and terms of payment
Our products and any additional services are billed at the price applicable on the day of delivery and payable to our head office. These prices may be revised at any time subject to economic conditions.
A 40% down payment is payable on placing the order. The balance is payable before goods are dispatched, except by special agreement. No discount shall be granted for prepayment No discount will be granted for early payment.
If payment is made after the date on the invoice, penalties will be applied automatically and without notice from this date and calculated at the latest ECB rate increased by 10 points. An indemnity of 20% (at least €1,500) of the unpaid amount on the due date shall also be payable. The buyer shall also bear all costs incurred by our company for recovery of the unpaid amounts. Payment default shall give rise to the right to suspend current or new orders.
7 – Retention of title
We retain title of the goods sold until effective payment of the total price (principal amount and incidentals) is received. A bill of exchange or documentary bill does not constitute payment. Notwithstanding this clause, the risk is transferred to the buyer upon delivery of the goods to the carrier. In absence of payment by the buyer of any fraction of the price by the agreed due dates and eight days after formal notice by registered letter with acknowledgment of receipt which has remained unanswered, the sale will be canceled automatically and without notice and the goods may be recovered in compliance the provisions of the laws dated May 12, 1980 and January 25, 1985.
In the event of receivership or liquidation, and in compliance with provisions in the law dated January 25, 1985, the claim to recover goods may be exercised within a period of three months from the decision opening the proceedings.
8 – Disputes and jurisdiction
Any dispute relating to this sale is covered exclusively by the Grenoble Commercial Court.
9 – Extended Producer Responsibility (EPR) System
